8. Mining operations must be wndncted aocording tu standard
practice. They shall be subject t0 supervision by the Joint Adminis-
tration which shnll prescribe such mensurcs as are nocessary for the
safety cf miners, the conservation of minerai deposits and public
snfely.
9. (a) A prospecting licence shal] constitute a personal right
which cannot be slinred, leased or mortgnpd. Subject to any resn
trictions imposer] by n joint enactment il may be oeded and tram»
ferred to any holder oi‘ a. personal authorisation.
(b) A mining lease shall consütute n right in real propeny of
limited duration which is distinct from the ownership of Lhe soil and
which may be mongaged. A mining Icase mny be ceded and leased
and subjecr to the prier authorisation ofthe Resident Commissionen
may be the subject of a merger or division.
(c) The authorisntions provided for in the two preoeding
paragraphs may be deferred or refused withont the interested parties
thereby uquiring any claim m indemnificntion. A special register
kept in the Department cf Mines and availabie for inspection (but
not removal) on request shall record:
the gant of prospecting licences and mining lenses together
with their withdrawal or renewal;
au relinquishments and trnnsfer together with ail civil and
judicial acta conœrning prospecting licences and mining
luses;
subdeasing cf mining leases.
10. The prospector or lessee may on being so antharised by
the Resident Commissioners—
within Lhc area of his licence or lease malte use of land
neoessary for his work and connocœd operntions, mit wood
necessary therefor and exploit nny unused water—falls;
outsidc the ares of bis licence or [me malte lise of land
necessary for me establishment of ronds of aoœss, snfety works,
stocks or industrially useful minerals and refining plants.
If Lhe land referme! w above is not privnte property, the antho—
risation will be given withaut payment.
If lhe lnnd or a portion oi' it is privnte property, authorisation
